Waititu allowed to amend appeal in Sh588 graft case


The High Court yesterday granted jailed former Kiambu Governor Ferdinand Waititu permission to amend his appeal against his conviction and sentencing in the Sh588 million corruption case.

Justice Lucy Njuguna of the Anti-Corruption and Economic  Crimes Division allowed Waititu to revise his petition to include a fresh application for bail and bond. “After considering the submissions from both sides, I found that a petition of appeal may be amended with the leave of the court. The application has merit and is therefore granted,” ruled Justice Njuguna.

Waititu is challenging the legal basis of his conviction and is seeking to be released on bond pending hearing and determination of his appeal. Previous attempts to secure bail have been dismissed by the High Court.

Despite this development, the former governor will continue serving his 12-year sentence while awaiting the court’s decision on the latest bail application.

Waititu has argued that he deposited a Sh50 million bond during his trial at the anti-corruption magistrate court, and he now wants that same amount to serve as security in the current appeal.

The appeal hearing has not commenced, as the court is first expected to resolve the issue of bail and bond terms.
