MP Were murder: Suspects arraigned, not charged


Police failed to produce businessman Philip Aroko in court on Thursday over the murder of Kasipul MP Charles Ong’ondo Were despite an anticipated plea taking.

According to his lawyers, Aroko was expected at the Jomo Kenyatta International Airport (JKIA) Law Court at 9 a.m. but was not brought before the magistrate hours later to face charges.

The legal team led by Danstan Omari petitioned the High Court to compel police to present him, arguing he was being held without formal charges or access to legal counsel, family or friends since surrendering Wednesday night.

The businessman, however denied any involvement in the killing of Kasipul MP Charles Were in cold blood on 30 April in Nairobi.

“This is politics and I’m ready for it. I started it and I want to pursue it to the last bit. I’m surprised to be called over the murder of the MP. I’m not partisan. I can’t be part of that kind of life,” said Aroko.

By law, suspects must appear in court within twenty hours of arrest, but it remained unclear if Aroko would be presented before the deadline after being booked at 12:18 a.m.

At the same time, five other suspects were brought to court but not charged after defence lawyers challenged the court’s jurisdiction, saying the killing happened outside its area.

Principal Magistrate Irene Gichobi is expected to rule Friday, May 9, at 10 a.m. on whether she will recuse herself as requested by the defence.

Until then, Aroko will be detained at Kasarani Police Station, with the other suspects held at various stations across Nairobi.
