Kenyans React as Court Lifts Orders Blocking Kindiki’s Swearing In: “Mlima Umevunjika”


Impeached deputy president Rigathi Gachagua has suffered a significant setback in his attempts to salvage his political career.

What verdict did High court make on Gachagua’s case?

On Thursday, October 31, a three-judge panel consisting of Justices Antony Mrima, Eric Ogola, and Freda Mugambi lifted the orders that had prevented Kithure Kindiki from taking office as deputy president.

This came after petitioners David Munyi and Peter Gichobi filed a court motion on October 18 to prevent Kindiki’s swearing-in until Gachagua’s impeachment case is heard.

During the proceedings, Gachagua contended that Kindiki’s nomination as deputy president was illegal because the outgoing Interior Cabinet Secretary was ineligible, having not been a member Kenya’s ruling party, UDA.

They also argued that Kindiki was still serving as the country’s Interior Cabinet Secretary when President William Ruto nominated him to replace Gachagua.

In its ruling, the three-judge panel stated that the deputy president’s office, as outlined in the 2010 Constitution, cannot be left vacant and emphasised the necessity for Kindiki to be sworn in.
