This comes after the High Court in Nairobi decided to schedule the mention of the petition challenging his ouster for January next year.
Why did High Court set the mention for 2025?
This occurred after petitioners in Gachagua’s case requested the court to await the Court of Appeal’s verdict on Gachagua’s challenge regarding the decision that Deputy Chief Justice had not violated the constitution by forming a three-judge bench comprising Justices Antony Mrima, Eric Ogola, and Freda Mugambi.
“As such any petitioner wishing to amend their petition shall do so and serve within 30 days from today, Thursday November 7. Regarding the state of proceedings pending appeal, the petitioners have told this court the court of Appeal undertook to hear and determine the pending appeal within this time.

As a result, the High Court in Nairobi scheduled the case for mention on January 23, 2025.
