Kirinyaga Woman Rep Slams High Court for Lifting Orders Barring Kindiki’s Swearing in: “Unfortunate”


Kirinyaga Woman Representative Njeri Maina expressed disappointment with a High Court ruling lifting orders that had blocked Deputy President-designate Kithure Kindiki from taking the oath of office.

Why was Njeri Maina disappointed?

Speaking after leaving the Milimani Law Courts, Maina, a strong supporter of Rigathi Gachagua, expressed discomfort with the ruling, calling it unfortunate.

“It’s unfortunate, but I am just disappointed. It is a sad day for the 2010 constitution. What is quite interesting is that the grounds that they are quoting are that we have a vacancy; once there are conservatory orders, you don’t have a vacancy. The 24 days that they are quoting don’t even operate,” she said.

Maina, also a High Court advocate, stated that Gachagua’s legal team will explore other legal avenues while supporting the independence of Kenya’s courts.

“We will still be pursuing other avenues of justice,I am greatly disappointed but I still believe in the rule of law.We must continue to support the independence of our judiciary even when they are disappointing,” she maintained.

The legislator, who has attended every court session challenging Gachagua’s impeachment, urged the former deputy president’s supporters to remain calm and maintain peace.

“What I can tell you is that this country is bigger than all of us. Let’s keep peace; we must have peace for the future,” she said.

The ruling was made by a three-judge bench consisting of Justices Eric Ogola, Anthony Mrima, and Fredah Mugambi.

Why did Kerugoya court bar Kindiki from being sworn in?

The High Court in Kerugoya had earlier issued orders barring Kindiki from assuming office as deputy president pending the hearing and determination of a case filed before it.

David Munyi Mathenge and Peter Gichobi Kamotho sought the orders after the National Assembly approved Kindiki’s nomination as the new Deputy President, a day after the Senate voted to impeach Rigathi Gachagua.

Mathenge and Kamotho have sued the Senate, the Speaker of the Senate, and two others.

The case was filed under a certificate of urgency before Justice Mwongo Richard Mururu. The case was later consolidated with others that had been filed in Nairobi.
