Kenyan Newspapers Review: Simple Mistake that Cost Gachagua in Impeachment Case

1. The Standard

A procedural blunder by former deputy president (DP) Rigathi Gachagua’s lawyers cost him a lifeline in his impeachment case in court.

The former DP’s lawyers served the initial parties in the case and left those who later enjoined in the case.

The technical error was used by the opponents’ lawyers to force an adjournment to next week.

Gachagua initially named the attorney general, the Senate, the two speakers of the August House, President William Ruto, the Law Society of Kenya and Kithure Kindiki as respondents.

However, the three-judge bench that heard the case added the Independent Electoral and Boundaries Commission (IEBC) and the United Democratic Alliance (UDA) as new parties in the consolidated cases.

Lawyers representing UDA, including Adrian Kamotho, argued that they had not been served with court papers, while those representing IEBC noted they were not added as respondents.

The three-judge bench deferred the matter to next week, as it lifted the conservatory orders blocking the swearing in of Kindiki as deputy president.

Law professor Kithure Kindiki is poised to become Kenya’s second in command after the court cleared the last hurdle in his way.

High Court judges Eric Ogola, Anthony Mrima, and Fred Mugambi ruled that they had jurisdiction to hear the petitions against Rigathi Gachagua’s impeachment.

The trio noted that the 2010 Constitution did not envision a scenario in which the Office of the Deputy President would be vacant except during the brief period required to fill it.

“As such, the public interest demands that the Office of the Deputy President should not remain vacant,” they ruled.

Kindiki will become the 13th principal assistant to the president in Kenya’s history.

3. The Star

President William Ruto’s government is facing a cash crisis that has halted most operations.

The cash crisis is attributed to high debt repayments that have forced the National Treasury to borrow expensive loans to sustain crucial operations.

As of June 2024, Kenya’s public debt stood at KSh 10.6 trillion, up from KSh 10.3 trillion during a similar period last year.

The current debt is inching closer to KSh 11 trillion, and the exchequer faces a huge deficit amid shrinking tax revenues.

The crisis was worsened after the withdrawal of the Finance Bill 2024, which sought to raise an additional KSh 350 billion.

Kenyan teachers have demanded a hefty pay hike and new perks in the latest push to improve their welfare.

Secondary school teachers want a pay rise of between 60% to 100% ahead of the National Delegates Conference in December.

They also proposed a standing allowance pegged at 30% of the basic salary, arguing that teaching while standing is stressful and tiresome.

Teachers also demanded that science tutors be paid a detoxification allowance pegged at 20% of their basic salary due to exposure to harmful substances in labs.

5. Taifa Leo

On Thursday, October 31, the police gunned down a suspect in the murder of Wells Fargo human resources manager Willis Ayieko.

Detectives tracked the suspect, whose name was not disclosed, to a guest house near Kisumu Polytechnic and shot him dead.

Police revealed the deceased was one of the two people who escaped after a gunfight with officers in Gem.

Nyanza regional commander Patrick Tito said they will continue with a manhunt for all suspects.
