When will High Court rule on Gachagu’s impeachment case

A three-judge bench comprising Justices Antony Mrima, Eric Ogola and Freda Mugambi will decide to seal Gachagua’s fate after being impeached by the Senate on October 17.

The judges will rule on Thursday, October 31, whether to approve or block the swearing-in of DP designate Kindiki.

Petitioners David Munyi and Peter Gichobi moved to court on October 18 to block Kindiki’s swearing-in until the hearing of cases against Gachagua’s impeachment.

During the case proceedings, Gachagua argued that Kindiki’s nomination as DP was illegal, as the outgoing Interior Cabinet Secretary was ineligible as he was not a member of the UDA party.

“However, his nomination as deputy president on October 18 allegedly included confirmation of membership status in a political party from the office of the registrar of political parties and membership confirmation from the UDA party,” Gachagua said.

The impeached DP further claimed that Kindiki had not resigned as CS for Interior before he was nominated deputy president as required under Article 148.

If the judges decline to lift the conservatory orders blocking Kindiki’s swearing-in, it will be a major win for Gachagua as, technically, he will still have hopes of retaining the seat.

However, if the three-judge bench lifts the conservatory orders issued by the Kerugoya Court, Gachagua’s hopes of serving as Kenya DP under President William Ruto’s administration will be shuttered entirely.
