Breakdown of Salaries, Benefits and Allowances of Chairpersons of Constitutional Commissions


The Constitution of Kenya 2010 established several commissions to carry out specific mandates as outlined by law.

These commissions are led by chairpersons, with their salaries and benefits determined by the Salaries and Remuneration Commission (SRC).

In a previous article, TUKO.co.ke highlighted the salaries and benefits of members of Executive, national and county government.

Below is a breakdown of their 2023-2024 remuneration, as well as the proposed 2024-2025 pay structure, which faced challenges following widespread protests by Gen Z that shook Kenya earlier this year.

Co-opted members of full-time Constitutional Commissions and Independent Offices will receive a sitting allowance of KSh 40,000 per sitting, capped at KSh 320,000 per month.

Benefits for state officers in full-time constitutional commissions and independent offices

(a) Official Transport:

State officers will be provided with an official car with an engine capacity not exceeding 3000cc.

(b) Medical Benefit:

An annual medical cover will be provided for the state officer, one spouse, and up to four fully dependent children under 25 years, with the following limits:

  • Inpatient: KSh 10 million
  • Outpatient: KSh 300,000
  • Maternity: KSh 150,000
  • Dental: KSh 75,000
  • Optical: KSh 75,000

The applicable interest rate for loans is 3% per annum. The loan duration is up to 20 years for mortgages and 5 years for car loans.

Special Responsibility Allowance

The Vice-Chairperson of full-time constitutional commissions will receive KSh 25,000 per month for additional responsibilities.

Daily Subsistence Allowance

Paid for local and foreign travels at SRC-determined rates.

Airtime Allowance

  • Up to KSh 20,000 per month: Auditor-General, chairperson, controller of budget, director of public prosecution.
  • Up to KSh 15,000 per month: Vice-chairperson, members, registrar of political parties, data protection commissioner, commission secretary/CEO.

Monthly Remuneration/retainer for EACC state officers:

  1. Chairperson – KSh. 365,000
  2. Vice-Chairperson – KSh. 310,000
  3. Member – KSh 290,000

Benefits for EACC officials

Sitting Allowance:

  • Chairperson: KSh. 50,000 per sitting (limited at KSh. 765,188 per month)
  • Vice-Chairperson: KSh. 45,000 per sitting (limited at KSh. 650,000 per month)
  • Member: KSh. 40,000 per sitting (capped at KSh. 610,000 per month)
  • Official Transport: Chairperson is provided with a car (engine capacity ≤ 3000cc)
  • Commuter Allowance: Vice-Chairperson and member: KSh. 30,000 per month

The chairperson is given KSh. 20,000 per month

Member (Non-MP): Benefits given to them before July 2024

  • Commuter Allowance: Official
  • Salary Market Adjustment: KSh. 169,600
